Helpful Facts and Hints About Workers' Compensation

Workers' compensation is governed by a complex set of rules and regulations. The process and procedures can seem overwhelming to an injured worker. That is why I have compiled a few helpful tips about how to avoid common pitfalls.

It is extremely important to follow the workers' comp process to the letter. Missing a deadline, failing to report your injury or file your claim or going to the wrong physician for treatment can cost you dearly. You may lose your right to workers' compensation benefits.

  • Report your injury to your employer right away. Tell your employer what happened as soon as possible. In general, Kansas workplace accidents must be reported to the employer within 10 days and given written notice served on the employer within 200 days. In Missouri, written notice of the accident must generally be given within 30 days. There are exceptions to these general rules. Talk to a lawyer about possible exceptions to these rules and advice on the proper way to report a workplace injury even if you think you may have missed a deadline.
  • Make sure your treatment is authorized by your employer and its insurance company. If you go to your own doctor, or pursue tests or treatment without authorization, workers' comp may not cover the expenses.
  • Attend all treatment appointments. If you miss a doctor's appointment or a visit with a physical therapist or other health care professional, your weekly checks may be terminated.
  • Hire an experienced attorney who focuses on workers' compensation. Insurance companies have their lawyers. You should have someone looking out for your best interests, too.
